TVEA's primary responsibility is to represent its members in their relations with their employers and to be the exclusive representative of appropriate units of school employees in all matters relating to employment conditions and employer-employee relations including, but not limited to, wages, hours, and other terms and conditions of employment.

YOUR RIGHTS

Weingarten Rights

  

The US Supreme Court has ruled that the National Labor Relations Act gives workers the right to request union representation during investigatory interviews by supervisors, security personnel and other managerial staff. These are called Weingarten Rights.

 

An investigatory interview occurs if

1) management questions you to obtain information: and

2) you have a reasonable apprehension that your answers could be used as a basis for discipline or other adverse action.

 

You must ask for union representation either at the beginning of or during the interview. Management does not have to remind you of this right. If your request is refused and management continues asking questions, you may refuse to answer. Your employer is guilty of an unfair labor practice and charges may be filed.

 

I REQUEST REPRESENTATION

If you are called to a meeting with management, read the following or present this card when the meeting begins. "If this discussion could in any way lead to my being disciplined or terminated, or affect my personal working conditions, I respectfully request that my Association representative be present at the meeting." 

 

THE STATEMENT ABOVE COULD SAVE YOUR JOB.

 

If you have any work-related problems, follow these guidelines:
  1. Do not resign or abandon your work location.

  2. All communication with your Association is strictly confidential.

  3. Document, in writing, the incident.

  4. Keep any records that related to the incident.

  5. Representation is strongly advised.

  6. Timeliness is important - don't delay.

  7. Use your contract as a guide.

  8. Follow orders unless there is potential for personal injury - you can grieve the orders later.

  9. Call your Chapter President for help.
